RECON ONE legal
Terms of Service
These Terms govern access to and use of the RECON ONE public website and publicly available materials.
These Terms of Service (“Terms”) govern access to and use of the RECON ONE public website and publicly available materials provided by Pollux Industries LLC, doing business as RECON ONE.
By accessing or using the website, you agree to these Terms.
1. Website Purpose
The RECON ONE website provides information concerning RECON ONE, its cybersecurity capabilities, research, services, and related materials.
Website content is provided for general informational purposes unless RECON ONE and a customer enter into a separate written agreement.
Nothing on this website creates a customer relationship, consulting engagement, professional-services relationship, or other contractual obligation to perform cybersecurity services.
2. Customer Engagements
Cybersecurity assessments, intelligence services, technical analysis, research engagements, or other professional services are subject to separately agreed terms, which may include:
- a master services agreement;
- statement of work;
- proposal;
- order form;
- data-handling terms;
- nondisclosure agreement; or
- other written agreement.
If a separate written agreement conflicts with these Terms regarding a customer engagement, the separate agreement controls to the extent of that conflict.
3. No Authorization Created by Website Use
Nothing on this website grants authorization to access, scan, test, probe, monitor, disrupt, exploit, or otherwise interact with any RECON ONE or third-party information system.
Cybersecurity activities performed by RECON ONE are subject to defined scope and appropriate authorization.
4. Acceptable Use
You must use the website and RECON ONE services lawfully and in accordance with the RECON ONE Acceptable Use Policy and any applicable customer agreement.
You may not use RECON ONE materials or systems to facilitate unlawful access, malicious activity, fraud, abuse, or unauthorized cybersecurity activity.
5. Intellectual Property
Unless otherwise stated, the website and its contents, including text, graphics, designs, software, methodologies, reports, documentation, trademarks, logos, analytical frameworks, and other materials, are owned by or licensed to Pollux Industries LLC.
RECON ONE and associated branding may not be used in a manner that falsely suggests endorsement, partnership, authorization, or affiliation.
No rights to RECON ONE technology, methods, models, algorithms, analytical systems, research, or other intellectual property are granted except as expressly provided in a written agreement.
6. Customer Information
Ownership and permitted use of information supplied in connection with customer engagements will be governed by the applicable customer agreement.
RECON ONE does not acquire ownership of a customer’s underlying data merely because the information is provided for an engagement.
Subject to applicable agreements, RECON ONE may use information collected or generated in connection with its services to operate, secure, improve, test, research, and develop its cybersecurity services, technologies, and analytical capabilities.
RECON ONE may create aggregated, de-identified, pseudonymized, statistical, or derived information where permitted by the applicable customer agreement and law.
7. Confidential Information
Confidentiality obligations applicable to customer engagements are governed by the applicable agreement between RECON ONE and the customer.
Users should not transmit confidential security evidence through unapproved public communication channels.
8. Informational and Cybersecurity Limitations
Cybersecurity analysis involves incomplete information, changing technologies, evolving adversary behavior, and other inherent limitations.
Unless expressly stated in a written customer agreement, RECON ONE does not represent or warrant that:
- all vulnerabilities or threats will be identified;
- an environment is secure;
- an organization is compliant with any particular standard;
- identified remediation will eliminate all risk;
- intelligence is complete or predictive of every future event; or
- use of RECON ONE services will prevent a cybersecurity incident.
Findings must be considered within the scope, evidence, assumptions, and limitations applicable to the engagement.
9. Website Availability and Accuracy
RECON ONE may modify, suspend, discontinue, or update website content at any time.
We attempt to provide accurate information but do not warrant that public website content is complete, current, error-free, or suitable for a particular purpose.
10. Third-Party Resources
The website may reference third-party standards, publications, organizations, products, websites, or resources.
Such references do not necessarily constitute endorsement or affiliation.
RECON ONE is not responsible for third-party content or services.
11. Disclaimer of Warranties
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE PUBLIC WEBSITE AND PUBLICLY AVAILABLE MATERIALS ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.
This provision does not modify warranties or obligations expressly stated in a separate written customer agreement.
12. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, POLLUX INDUSTRIES LLC AND ITS MEMBERS, MANAGERS, OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING SOLELY FROM USE OF OR RELIANCE ON THE PUBLIC WEBSITE.
Liability arising from a customer engagement will be governed by the applicable written customer agreement.
13. Indemnification
To the extent permitted by applicable law, you agree to be responsible for claims, damages, or expenses arising from your unlawful or unauthorized use of the RECON ONE website or materials.
Customer-specific indemnification obligations, if any, will be established separately in the applicable customer agreement.
14. Governing Law
These Terms are governed by the laws of the State of Washington, without regard to conflict-of-law principles, except where applicable law requires otherwise.
15. Venue
Any judicial proceeding arising solely from these Terms or use of the public website will be brought in a state or federal court located in the State of Washington having jurisdiction over the dispute, except where applicable law requires otherwise.
16. Severability
If any provision of these Terms is found unenforceable, the remaining provisions will remain in effect to the extent permitted by law.
